Eulogy for Friend My name is Deborah, and I’m one of Ron’s many friends. Karen asked me to share about Ron from a biker’s point of view. At many memorial services, eulogies are sort of like fish stories. Mean people are suddenly remembered as good-natured, self-centered people as generous, sinners as saints. Positive traits are exaggerated, negative ones swept under the rug. But today, it’s not necessary to stretch the truth. With Ron, what you saw was what you got. He refused to play games with people, and he was adamant that he â€Å"didn’t have time for nonsense† like politics and petty disputes. What he DID have time for was people. He was amazingly attuned to other people’s feelings. In my case, Ron would always notice if I started getting tired and quiet while we were riding. He noticed before my husband of 30 years did—before I did myself!—and would invariably stroll over with a handful of Tootsie Roll Pops and pink bubble gum to give me a sugar shot. Once he discovered that I shared his enthusiasm over Tootsie Roll Pops, he always made sure to keep a big enough stash to â€Å"cover† me on trips. He was attuned in other ways as well. On group rides, I usually take the tailgunner position at the end of the pack, which means that I sometimes have to babysit unskilled riders who constantly speed up and slow down, or who fall back so far that the rest of the group vanishes from sight. I usually don’t mind, but now and then when somebody who should know better rides like that, it drives me crazy. Ron would always sense when I was getting frustrated, and at the next stop he’d say, â€Å"Why don’t I ride at the back for a while and give you a break?† He didn’t make a big deal out of it, but he helped keep rides fun for many of us. Ron was master of a thousand small kindnesses. He also took setbacks in stride, small and large ones alike. One time we were heading south toward Austin, and Ron and Karen were riding in front of me. Suddenly there was a small and colorful explosion on the road behind their bike. I looked down and saw pills--lots of little pills!--bouncing in every direction. Then two more explosions occurred, and this time I saw that the bottles were coming from their T-bag. Ivan Illich was an Austrian philosopher, very popular for his of contribution of theories on the concept of medicalization. He has published many books on medicalization and has presented to a wider public the notion of iatrogenic disease. Medicine is a major therapy tool in social life and without proper medication human life could be highly constrained by many diseases surrounding it. Ivan Illich has had a contribution in the field of medicalization as a philosopher by constructing theories that various medics have followed in their practice. Iatrogenesis is a term that is used to refer an illness that come from medical activity and outweighs any positive benefit of medicine. Iatrogenesis was introduced into social science by Illich. According to Illich, iatrogenesis had adverse effects on the industrial society as it enhanced the corruption, incapacitated individuals and limited freedom in an industrial set up. Illich outlined three major types of iatrogenesis, these are; clinical , social and cultural iatrogenesis. Illich has theorized various ideas in medicalization and society. This essay will point out some theories that highlight whether Illich was a prophet or a rumormonger in society and show some evidence based on his approaches in medicalization. The essay will as well focus on the notion of iatrogenesis and statistics that has been conducted in the UK based on statistics. Finally, the essay will show some assumptions of Illich on medicalization and also how iatrogenesis can be prevented in society. According to statistics in the UK, it indicates that the estimation of 215,000 deaths every year have been caused by iatrogenic, whereby cancer and the heart disease are seen to be causing more deaths in every year(Shaffer, Philips, &Enzer, 2009, p.241). Iatrogenic effects in several cases are fully defined and can be recognized easily, for instance those complications that need a surgical procedure. However, the less obvious complications need significant investigation to recognize, such as difficult drug interactions. Ivan Illich who was a researcher and a multilingual prolific writer on issues related to society and medicine attributed his concepts of medicalization and proposed his views towards the modern medicine in the society. Illich argued that the notion of medicine had deprived individuals and society of their capacity to cope with sickness and death (Basford, Lynn & Oliver Slevin, 2003, p.122). Therefore, based on Illich, iatrogenesis cannot be understood unless it is seen specifically medical manifestation of particular counter productivity. Illich therefore points out main three levels of iatrogenesis. The first level is the clinical iatrogenesis, this whereby the injury is depicted to the patients by unproductive, toxic and insecure treatment to the patients. The second level is the social iatrogenesis, which comes as a result of medicalization of life, and thirdly cultural iatrogenesis, which comes as a result of the destruction of traditional ways of dealing with and making sense of death, pain and illness. Based on the evidence in his works of medicine described for over twenty years, it is noted that Illich was not a rumormonger, but a philosophical prophet, based on his predictions and research on the concept of iatrogenesis. Ivan Illich has traced contemporary idea of the issue of epidemic in the societal context and this notion has greatly focused on the main assumptions that lead to that epidemic. Based on his ideas, he argued on the progressing views on medicine, there is an empowerment model that has evolved out of the realization of epidemic and, therefore, patients cannot be forced to follow a lifestyle dictated by others towards the problem of medicalization. Based on Ivan Illich’s theories on his perspectives towards natural health, medicine undermines health of individuals not only based directly on aggression, but also over the impact of its social organization on the milieu. On that context, when the medical damage to the health of an individual is produced based on the sociopolitical mode of transmission. Thus, according to Illich, social iatrogenesis is designated in all impairments on regard to health that specifically to those socio-economic revolutions which have been made pretty, probable, or essential by the formal shape health care has taken (Kazer, 2008, p.209). Thus, based on his views towards the medicalization, the assumptions that erupt prevail that Illich was one person in the society who was seen as a prophet. The iatrogenic death has become the third leading cause of death in the UK, surpassing the death by stroke. On the same note, it is seen that deaths by ADRs kills over five times as the illegal combined in every year and that is the most conservative estimate that is outlined. Thus, the prescription drug Vioxx kills an estimate of 60,00 people by cardiac arrest alone and this figure does not reflect and account for any other fatal side effects such as the internal bleeding. In most cases, medicine undermines health and this is not only based on direct aggression against individuals but it has also an impact on the social organization on the total milieu. Therefore, medical damage to the individual health is enacted by the social iatrogenesis. Prevention is the most crucial factor and determining the effective way to prevent such assumption is to overlook on that factors that contribute to such infections. After full recognition of that factors, focusing on the proper measures that should be taken into consideration to avoid those elements that affect the situation (Miller, 2013, p.178). Thus, interventions that can prevent iatrogenic complications may include the following: addressing proper medication to the patient by relying on primary evidence. In conclusion, Illich can be considered a prophet and not a rumourmonger. A prophet according to religion is a person who can tell about the future. This declaration has evolved from a number of his assumptions on medicine and his approaches towards the medicalization that are entirely based on his research of over twenty years. For instance, in UK there are several individuals who die of diseases linked to the effect of iatrogenesis in every year. This aspect is seen to affect the elderly people more than the young. Illich’s views on medicalization are shown to be very significant to the society as they enlightened individuals to be aware of some aspects that lead to iatrogenesis. With the evidence on health system, his philosophies are examined to be very significant in society since they mainly focused on the main areas that analyze medicalization. His predictions in several aspects support his research on the health systems in society and this fully defines him as a prophe t. It has been documented that no substantial addition to life expectancy or the quality of life critically ill patients has been achieved by high tech cost medical technology. Neha: Why did you buy this product and what are the attributes you look for? Kamal: I have been using this product for quite a long time. The main attributes are quality assurance and cost factors. Its re-fill pack is also a good attribute, as once you buy the pump pack; you can get the re-fill at much lower cost. It is reasonably priced and also the dettol is a well known brand. Neha: Have you used any other brand of liquid handwash? If yes, then what motivated you to try the other brand? Also, what made you come back to dettol? Kamal: Yes, I have also used Lifebuoy hand wash. I have tried lifebuoy once or twice, mainly because of the non availability of the dettol hand wash in the local store from which I get the monthly ration. So, when dettol is available, I go for that only. Neha: Why didn’t you choose to wait for the new stock of dettol liquid hand wash to arrive? Kamal: Hand wash is a product of daily use, so availability is necessary. Also, Lifebuoy, dettol and a couple of other brands are almost similar in pricing and quality. Thus, there is no incentive in waiting for new stock. Neha: Have you been using this product for long? Where did you get information about this product? Kamal: Yes, I have been this product for quite some time. I got to know about this product from advertisements in television. Also the displays in the store from which I buy most of my daily needs products , also helps me make an informed decision as I can compare the prices of different brands and also the various discounts and schemes offered. Neha: Which store do you go to? Any specific reason to choose that particular store? Kamal: I go to the local departmental store in the market near to my house. I choose this store as it is nearby and I can get everything from kitchen products to sanitary products to everything. It has wide variety of products available which makes my job easier. Summary: From the above survey, following are the conclusions that can be drawn about the consumer preference and the demand of a daily mundane product of less than Rs. 75/-. Stock Availability: One of the most crucial factors for low price daily products is the availability. As they form the daily needs of the consumers, non availability of the product is not an option. Consumer will quickly switch to a new brand. Competitive Pricing: For daily products like hand wash, face wash etc. pricing plays an important role in consumer opting for a particular product. As lots of options offering almost comparable quality and price are available, pricing is very important to attract the consumers. Consumer Loyalty: Consumer loyalty also plays a significant role in the sales of the product in question. A common answer as to why they continue to buy a given product is, that they have been using the product for very long time and never faced a problem. Hence, as long as the product is consistent in quality and pricing, consumers tend to be loyal to one brand as they get used to it. Promotion: Advertisements in television/print and display in the retailer store is the main source of information for the consumers. Attractive advertisements may prompt the consumer to try out a different product and thus effective promotion campaign is needed to sustain consumer interest. As the consumer is mainly the budget conscious house wives, discounts and schemes are another effective means to maintain consumer base and also attract new consumers.

Examining Cell Phone Effects Essay

Kailla Schlimm’s article â€Å"The Effect of Cell Phones in Modern Society† addresses issues on how cell phones have altered modern day society. Schlimm’s article is mainly targeted towards children and teenagers. She begins by expressing the main point that some people rely on their cell phones for everything and gives reason of why this may be and list examples. Schlimm then extends her argument and tells how cell phones are used and what they are used for. Schlimm also confers how cell phones may be great, but they also can cause problems. After each problem is addressed, the reader may want to stop and think about the positive effects and negative effects of cell phones. Schlimm focuses on the many problems that cell phones can cause. In doing so, she reveals examples of danger and harm that they may cause. She begins by proposing explanations of how cell phones can be used improperly. For example, she say â€Å"Phones of the twenty-first century may be great at times, but at the same time the do cause a few problems. For instance, there are people who text and drive† (Schlimm). Schlimm then makes a reference to how this problem may add to the chance of getting into a car wreck even more than drinking alcohol and driving. She explains how this increases problems for the safety of the person texting, as well as all the other drivers. Not only does Schlimm address problems that occur while driving, she also approaches problems that are increasing in schools and homes. Schlimm declares, â€Å"Children are becoming distant for their parents because they are always on their phones focused on other less important thing.† After her statement she explains how some children admit to playing games during dinner, or even church. Also how students use their cell phones to text during school, and their cameras to cheat. She ventures on to acknowledge how these actions cause problems in relationships, families, and the workplace. Overall, Schlimm has her article formatted well. She addresses and lists the problems the have arose since cell phones have become a vital part of society. She provides reasoning and examples behind each statement made. She says, â€Å" Cell phones are basically miniature computers.† She adds that sooner or later there will be no need for computers at all. If this statement is true, it proves that cell phones have had an enormous effect on society and have taken over lives. Schlimm’s essay was effective in many ways. She has fully presented each statement without out-weighing the positives and negatives. . One thing Schlimm could have done differently is given herself more credibility to equal out the balance of the logical and facts and examples she expresses. She could have given an example of a positive time where she has used a call phone and a negative. This would have made the reader feel more inclined to believe that all of her statements are true. With all the facts she finishes by saying that cell phones can be very negative at times and may cause problems, but when they are used properly they may be a wonderful thing. Chattel is a term in the world which refers to personal property which can be moved; it is also known as movable property. Some examples of chattel include jewelry, cars, and furniture. Some people just call chattel â€Å"personal property,† differentiating it from things like real estate with the term â€Å"immovable property. † Assessors also look at building value under the cost analysis method, but only in terms of how much it cost to construct them. The corporation determines, at the outset of incorporating, how many shares it shall issue and what classes of shares (No Par, Par, Common, Preferred, Participating, tc. ) it will issue. Valuation Procedures 1. Cost Approach – valuation method is based on the principle that no prudent purchaser will pay more than what it cost him to acquire an equally desirable substitute site and to build a similar improvement of equal desirability and utility. 2. Income Approach – based on the principle that value tends to be set by the present worth of the right to future net benefits that may be derived from ownership. Deed of assignment CHAPTER 11 SHARES OF STOCKS AS COLLATERAL Capital stock has to do with all the shares of stock that represent the ownership of a given company. Voting rights can be important because they allow people to vote on members of the board of directors, policy, and stock splits, which gives them a role in the governance of the company. Convertible preferred stock is a type of preferred stock that has the option of being converted into common shares issued by the same company. One of the less commonly employed approaches of issuing shares of stock. Participating preferred stock dividends are usually a fixed percentage of the par value of the stock. Participating preferred stock owners usually do not have any voting rights at stockholder meetings. CHAPTER 12 LAND AS COLLATERAL Collateral is borrowing funds often requires the designation of collateral on the part of the recipient of the loan. Collateral is simply assets that have been pledged by the recipient as security on the value of the loan. In the event that circumstances make it impossible for the recipient to repay the loan, ownership of the collateral is transferred to the entity that issued the loan in order to settle the debt. CHAPTER13 COLLECTION POLICIES AND PROCEDURES Collections are a part of a process in the accounts receivable or billing department. It means that, at some point in time, a company xtended to another company or an individual credit terms for goods or services, or a cash loan advance of some kind that was to be paid or repaid at a certain time. If that bill is not paid when it is due, or within an agreed upon grace period, the collection process begins. Collection procedures usually consist of a set of in-house company policies that are written in a manual or guidebook of some kind, though smaller compan ies may not have a manual. Usually, law firms that engage in collection practices will have manuals and training classes for their employees before they make their first collection call to a debtor. Most of the time, large corporations and small companies have a collection manager or collection department that will go through certain housekeeping procedures before an unpaid debt is turned over to a lawyer. Laws and Regulations The laws that cover collection policies and procedures are mandated by federal and state governments. On the federal level, the Federal Trade Commission regulates what is called the Fair Debt Collection Practices Act (FDCPA). In the case of a conflict between state and federal law, federal law prevails. Those who extend credit to others should be aware of the legal rules about how to collect money that is past due, particularly as those rules apply to bankruptcy. A collection policy is a set of business practices and procedures that outline the way a company goes about collecting money owed to it as a result of an extension of credit. Companies often allow their best business customers to establish payment terms that give the customer an extended amount of time, such as 30, 60 or 90 days, to pay an outstanding invoice. Other companies extend credit to individual consumers and implement a collection policy to control the process of obtaining payment on the credit account. Credit extensions allow individual consumers to obtain needed merchandise upfront but pay for purchase over time. In the case of business-to-business transactions, the extension of credit is carried on the supplier’s book under accounts receivable. Extensions of consumer credit are typically carried on the books under a separate consumer credit category that is also a type of receivable. Accounts receivable is a company’s list of outstanding extensions of credit to customers. The company’s collection policy establishes how the accounts receivable or collections department should go about reminding customers that payments are due and how the department should handle delinquent accounts or accounts that are not paid as agreed. Types of Bad Debt Buyers Also known as junk debt buyers, bad debt buyers are firms that purchase unpaid debts from different types of creditors at rates that are below the actual face value of the debts, and then attempt to collect the full amount plus interest and penalties from the debtor. Bad debt buyers sometimes specialize on securing and collecting specific types of debt, including credit card debt, business debt, or loan debt. Credit card bad debt buyers are one of the more common types of junk debt buyers. Here, the buyer purchases old credit card accounts with outstanding balances that the originator was unable to collect. CHAPTER 14 BANKRUPTCY Bankruptcy is the process where a person legally declares himself or his business unable to pay outstanding debts. Depending upon the type filed, one meets with a judge to determine a payment schedule, or have a legal bankruptcy discharge most if not all debts. Businesses also may declare bankruptcy, which either means the business will close, or that the business will continue to operate with reduced payments to debtors It depends on what type the person intends to file, and also how quickly he or she can gather together information about his or her income and debts. Bankruptcy is the most common proceeding, and it is usually filed when a person doesn’t have a large number of assets that he or she needs to protect. Financial distress may also occur due to unforeseen factors that have an adverse effect on the different revenue streams that the corporation enjoys. The bankruptcy action may be necessary to protect the business from creditors while the company is reorganized under the direction of the courts, allowing the corporation to at least have a chance of getting back on a firm financial foundation. Liquidation maybe partial or complete, depending on the amount of debt involved. With a partial liquidation, the business sells off assets, including divisions of the business that are not needed for the continued operation of the core businesses. A complete liquidation means the selling of all assets and the eventual dismantling of the company as a business entity. Insolvency is the inability of a person to meet his obligations as they mature (Equity sense). It refers to the excess of liabilities, in the case of corporation, excluding capital stock over assets. (Bankruptcy sense) Two types of Insolvency Voluntary Insolvency Under voluntary insolvency, an insolvent debtor, owing debts exceeding in amount the sum of P1,000. 00 may apply to be discharged from his debts and liabilities by filing a petition with the Court of First Instance of the province or city which is the domicile of the petitioner for six months preceding the petition. He shall moreover annex to his petition a schedule and inventory in the form as prescribed under the Declaration of Insolvency Upon receipt of such petition, together with the schedule and inventory, the court or the judge thereof in vacation, shall make an order declaring the petitioner insolvent. Involuntary Insolvency an adjudication of insolvency may be made on the petition of three or more creditors, residents of the Philippines, whose credits or demands accrued in the Philippines, and the amount of which credits or demands are in the aggregate of not less than one thousand pesos. Provided, that none of the said creditors has become a creditor by assignment, however made, within 30 days prior to the filing of said petition. The following shall be considered acts of insolvency, and the petition for insolvency shall set forth one or more of such acts: 1. That such person is about to depart or has departed from the Philippines, with intend to defraud his creditors; 2. That being absent from the Philippines, with intend to defraud his creditors, he remains absent; 3. That he conceals himself to avoid the service if legal process for the purpose of hindering or delaying or defrauding his creditors. 4. That he conceals, or removing, any of his property to avoid its being attached or taken in legal process; 5. That he has suffered his property to remain under attachment or legal process for 3 days for the purpose of hindering or delaying or defrauding his creditors; 6. That he has confessed or offered to allow judgment in favor of any creditor or claimant for the purpose of hindering or delaying or defrauding his creditors or claimant; 7. That he is willfully suffered judgment to be taken against him by default purpose of hindering or delaying or defrauding his creditors or claimant; 8. . That he has suffered or procured his property to be taken on legal process with the intent to give a preference to one or more of his creditors and thereby hinder, delay or defraud any of his creditor; 9. That he has made any assignment, gift, sale, conveyance, or transfer of his estate, property, rights, or credits for purpose of hindering or delaying or defrauding his creditors or claimant; 10. That he has, in contemplation of insolvency, made any payment, gift, grant, sale, conveyance, or transfer of his estate, property, rights, or credits; 11. That being a merchant or tradesman has generally defaulted in the payment of his current obligations for period of 30 days; 12. That for a period of 30 says he has failed after demand, to pay any money deposited with him or received by him in a fiduciary capacity; and 13. That an execution having been issued against him on final judgment for money, he shall have been found to be without sufficient property to execution to satisfy the judgment.
